1. Acceptance of Terms

By creating an account, accessing, or using Frank Resume, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Frank Resume.

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Description of Service

Frank Resume is an AI-powered platform that helps users optimize their resumes and generate cover letters for job applications. The Service employs multiple specialized AI agents powered by Anthropic Claude to analyze resumes against job requirements and suggest improvements to increase ATS (Applicant Tracking System) compatibility scores. Our features include resume upload and management, AI-powered resume optimization with multiple specialized agents, ATS score analysis and job match assessment, cover letter generation, resume merging, and document management.

The Service is designed as a tool to assist you in your job search process. It is not a recruitment agency, employment service, or career counseling firm. The AI-generated suggestions and optimizations are provided as recommendations only and should always be reviewed and verified by you before use.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Each individual may maintain only one account. We reserve the right to suspend or terminate accounts that we reasonably believe violate these Terms, contain false information, or are being used for fraudulent purposes. Multiple accounts created by the same individual may be merged or terminated at our discretion.

4. Credits, Payments & Refunds

Frank Resume operates on a credit-based system. Credits are required to use certain AI-powered features such as resume optimization and cover letter generation. Credits may be obtained through free trial allocations or by purchasing credit packages. Credit prices are displayed at the time of purchase and are subject to change.

All payments are processed securely through Stripe. Frank Resume does not store your credit card information. By making a purchase, you authorize Stripe to charge your selected payment method for the total amount of your order. All sales are final once credits have been consumed by an AI operation.

Unused purchased credits do not expire. However, free trial credits may be subject to expiration or modification at our discretion. We reserve the right to modify pricing, credit packages, and credit costs for operations at any time, though such changes will not affect credits already purchased.

5. User Content

You retain full ownership of all content you upload to the Service, including resumes, cover letters, and job descriptions ("User Content"). By uploading User Content, you grant Frank Resume a limited, non-exclusive, worldwide license to process, store, and transmit your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or your account.

You represent and warrant that you own or have the necessary rights to all User Content you upload, that your content does not infringe any third party's intellectual property or other rights, and that your content is accurate and truthful. You are solely responsible for the content of your documents, including any information that may be false, misleading, or inappropriate.

6. AI-Generated Content

Our Service uses artificial intelligence powered by Anthropic Claude, a third-party AI provider, to analyze and optimize resumes and generate cover letters. You acknowledge and agree that: (a) AI-generated content may contain errors, inaccuracies, or suggestions that are not appropriate for your specific situation; (b) you are solely responsible for reviewing, verifying, and editing all AI-generated content before use; (c) Frank Resume does not guarantee employment outcomes or that AI suggestions will improve your job prospects; (d) the final accuracy and appropriateness of your resume is your responsibility.

When you use our AI features, your document content is sent to Anthropic (Claude AI) for processing. Anthropic acts as a data processor under our instructions. Anthropic is contractually prohibited from using your data to train, improve, or develop their AI models. We do not sell or share your personal data with AI providers for any purpose beyond delivering the service you requested.

AI-generated resume content does not constitute professional career advice, legal advice, or any other form of professional consultation. Our AI tools are designed to assist you in improving your resume's formatting, keyword optimization, and ATS compatibility. For specific career guidance tailored to your individual circumstances, we recommend consulting a qualified career counselor.

We actively monitor and refine our AI systems to minimize the risk of biased, inappropriate, or discriminatory suggestions. However, AI technology has inherent limitations and no AI system can guarantee perfect, unbiased results. We recommend that you carefully review all AI-generated content to ensure it accurately represents your experience and professional identity.

We clearly indicate when content or suggestions are generated by our AI systems. You should always distinguish between your original input and AI-generated output, and never present AI-generated content as your own work without thorough review and personal verification of all facts, dates, qualifications, and claims.

7. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in violation of these Terms. Prohibited activities include but are not limited to: uploading content that is fraudulent, false, misleading, or deceptive; creating resumes with fabricated credentials, qualifications, or work experience; using the Service to harass, discriminate against, or harm others; attempting to circumvent, disable, or interfere with security features of the Service; using automated systems (bots, scrapers) to access the Service without authorization; reselling, sublicensing, or commercially exploiting the Service without written permission.

We employ automated content moderation systems to detect prohibited content. Violations may result in warnings, account suspension, or permanent termination depending on the severity and frequency of violations. Repeated or severe violations may result in immediate account termination without refund of unused credits.

8. Intellectual Property

The Frank Resume platform, including its software, design, logos, trademarks, and all associated intellectual property, is owned by Frank Resume and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use the Frank Resume name, logo, or trademarks without our prior written consent.

As stated in Section 5, you retain ownership of your User Content. Any AI-generated content produced by the Service based on your input is provided to you for your personal use. You may use, modify, and distribute the AI-generated output as part of your job application materials. However, the underlying AI models, algorithms, and technology used to generate such content remain the property of Frank Resume and its technology partners.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FRANK RESUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR: (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY LOSS OF EMPLOYMENT OPPORTUNITIES, INCOME, OR CAREER PROSPECTS ALLEGEDLY RESULTING FROM USE OF AI-GENERATED CONTENT; (C) ANY ERRORS, INACCURACIES, OR OMISSIONS IN AI-GENERATED CONTENT; (D) ANY DECISIONS MADE BASED ON AI SUGGESTIONS OR OPTIMIZATIONS; (E) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENTS, OUR MAXIMUM LIABILITY SHALL NOT EXCEED FIFTY US DOLLARS (USD $50.00).

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR YOUR NEEDS; (C) THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL MEET YOUR EXPECTATIONS; (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED; (E) THE SERVICE WILL BE COMPATIBLE WITH YOUR DEVICES OR SOFTWARE. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Indemnification

You agree to indemnify, defend, and hold harmless Frank Resume and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights, including intellectual property rights; (d) any content you upload or submit through the Service; (e) any false, misleading, or fraudulent information in your resume or other documents created using the Service.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, extended periods of inactivity, or at our sole discretion. You may terminate your account at any time through your account settings or by contacting our support team.

Upon termination: (a) your right to use the Service will immediately cease; (b) any unused purchased credits will be forfeited unless otherwise required by applicable law; (c) we may delete your account data in accordance with our Privacy Policy; (d) provisions of these Terms that by their nature should survive termination (including Sections 5, 6, 8, 9, 10, 11, and 13) will continue to apply.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Frank Resume operates, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where appropriate, by sending you a notification through the Service or via email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the Service and may request deletion of your account. It is your responsibility to review these Terms periodically for changes.
